How would you feel if this happened to you? You could not be more wrong if you live in the state of New Jersey, due to “no fault car insurance”, which was adopted in the state in the early seventies, to help stabilize car insurance premiums, meaning that car drivers were legally bound to be covered, in the event of serious personal injury and Personal Injury Protection (PIP), was born. Meaning that no matter who was to blame for the accident, you are liable to share some of the risk, which in turn could cost you in the region of between $250-$2,500.

Another added stipulation, was that you could not apply to file a lawsuit, against the party who was to blame for the original accident, with the only exception being in the event that you sustained a permanent injury.

So this ultimately means that you having a stroll to the store for your milk and not driving your car, being hit by a car whose driver was at fault, costing your bank balance to fall over $900 and the car drivers car insurance remaining claim free and the driver merrily on his way, with no penalty for their bad driving, makes no sense at all, does it?

So how can you get round this? The only thing that is worth a try is to claim the cash from the driver’s car insurer, even though your PIP policy says that you cannot claim from the driver’s policy, most will pay up, due to the fact that you may turn to some unscrupulous lawyer, who will in turn send the claimant, to an even shadier doctor, who after giving the injured party the once over, discovers that the injury that they have sustained, is a lot worse than was first imagined, thus costing the card insurance companies payments reaching into the thousands, so it is easier and far less costly for them to pay the original cost to the claimant.
